RENTAL CONTRACT – FURNISHED EXECUTIVE SUITES

IN THIS CONTRACT the words “WE”, “US”, and “OUR” means the OWNER, WHITESTAR REALTY TRUST.

The words “YOU” and “YOURS”, means the OCCUPANT(S), _________________________________

We agree to Contract Short Term Rental to you and you agree to rent from us Suite ___ located at ____________________________________________________________________________
 
         The above named parties agree to the following terms:

1.  TERM:     The term of this Contract will begin on ___________________ and will end on or by

_________________________.

2.  FEE:         The Fee will paid by on or by the _________ day of Every Month  in the amount of ______________ per month.  No written notice or invoice will be sent for the Rental Fee.  It is understood between the parties the Rental Fee will be paid by or on the due date of Each Month within the Contract Term.  Receipts will be issued upon request.  After the contract term as stated in Paragraph 1 and upon 30 day written notice the fee will be pro-rated at an amount of _________ per day.

3.  USE:        The Premises will be used only as a Dwelling.  No more than _____  people will live in the dwelling, and you will not Sublease or Contract the dwelling to any other individual.    

4.  LAWS:    You will comply with any laws and regulations regarding the premises.  You will not allow any persons to violate any laws or regulations on the premises.  You will pay any fines or penalties incurred by any violations of said laws and regulations.

5.  CARE OF THE PREMISES:     You will keep the premises, all fixtures, and appliances in a clean and safe condition.  You will remove all garbage, rubbish and debris in a clean and safe manner to the area provides by us.  You will use all electrical, plumbing, heating, and appliances in a safe and reasonable manner.  Occupant will be responsible to place felt on bottoms of any furniture brought in that is placed on hardwood flooring to protect flooring from scratches.  Failure to do so will result in Occupant paying to repair floors.  Only wood cleaning products may be used to clean hardwood flooring.  You will not damage or destroy any part of the premises or any of the blinds and appliances provided by us, including but not limited to ceilings fans and fixtures, refrigerator, stove, and dishwasher, which are the property of Whitestar Realty Trust.

6.  UTILTIES:      We will provide all utilities, telephone service with local calling, basic cable with HBO and wired internet.  Wireless internet can be utilized with Occupant provided hardware.

7.  ENTERING THE PREMISES:     We may enter the premises with reasonable notice to you, to make necessary changes and repairs, and to supply the agreed upon utilities.  We may enter the property to show the premises to any lenders, tenants, workers and contractors.  You will not unreasonably deny us the right to enter the premises.  We may enter the premises without your consent only in the case of an emergency. 
     
8.  DAMAGE TO THE PREMISES:      You will not pay rent if fire or any other casualty substantially affects your use and right to enjoyment of the premises.  HOWEVER, you will continue to pay the set fee if the damage is caused by your negligence, and you continue to occupy any portion of the premises.  Your fee shall be reduced by the decrease in fair rental value of the premises. 

9.  CHANGES:    You will not make any cosmetic or structural changes to the premises or its contents, including but not limited to walls, floors, carpeting, windows, doors, appliances, and fixtures without written consent from us.  Any changes or installations approved by us will immediately become the property of Whitestar Realty Trust upon the termination of this Contract.

10.  REMOVAL OF PERSONAL PROPERTY:     When this Contract expires, you will remove all personal property from the premises.  You will not remove any fixture, furnishings, or property belonging to us.  You will leave the premises in a clean condition, and you will repair all damaged caused by you at your expense.

11.  DEFAULT:     You will be in default under this Contract if:

  1. You do not make payment of Monthly Rent within Three (3) days after it is due,
  2. You violate or do not fulfill your obligations agreed to in this Contract, and
  3. You vacate the premises for an extended period.

 

If you are in default under this Contract, we may terminate this Contract with Notice.  This Contract will end upon your receipt of said Notice.

You will be financially responsible for any expenses incurred for your failure to fulfill your obligations under this Contract.   Your cancellation of the Terms of this Contract, without a 30 days written notice, will result in payment of all rents owed for the term of thirty days.

You will pay interest on any rent monies owed to us by you which is considered past due.  The interest rate will accrue at eighteen (18) percent annum.

If you default under this Contract and the matter is referred to our Attorney to evict you, you will pay all reasonable attorneys’ fees, collection costs and expenses incurred by us.  If the past due amount goes uncollected and is referred to court, and judgment is found against you, you will pay us an attorney fee not to exceed thirty (30) percent of judgment amount. 

13.  DEPOSIT:     First months rent and signing of contract due at time of agreement will reserve unit.  There will not be a deposit required unless there is failure to pay on or before the rent is due according to Paragraph 2.  There will be a $500.00 deposit required if you have pets and it is agreed upon with Whitestar Realty Trust prior to occupancy as stated in Paragraph 19.  Deposit will be returned once inspection for damages/cleaning is completed and within (30) days of vacating.

14.  CLEANING:  If the premises are found in a condition other that that in which you moved, less reasonable wear and tear, a cleaning fee will be charged at a rate of $75.00 per hour. 

The apartment and all appliances listed above are found to be in clean and undamaged condition.  __________ (INITIAL)

15.  MISCELLANEOUS:     If this Contract is signed jointly, both parties signing this Contract are responsible to fulfill the obligations under this Contract.  We can delay enforcing any of our rights under this Contract without losing them.  If we release you from this Contract, the remaining party shall fulfill the obligations of this Contract.

In the event we name a new property manager, we will give you written notice within five (5) business days. 

17.  SEPARATE PROVISIONS:     If any provision of this Contract is invalid or unenforceable, the other provisions of this Contract will apply.

18.  BINDING EFFECT:  This Contract shall be binding upon you and your respective successors, heirs, executors and administrators.

19.  PETS:      No dogs or other animals, birds, cats, or pets shall be kept in or on the premises without written consent, and consent if given may be revoked at any time, and will become part of this contract. 
Any damage or cleaning caused by pets will be paid for by the Occupant.  No pet is to be left outside of the suite without the occupant and a leash.  Occupant is responsible to immediately clean up the yard after pet.

20.  OPTION TO EXTEND:  This Contract may be extended for an additional thirty (30) days upon a 15 day notice to Whitestar Realty Trust.  The rate will be agreed upon prior to the additional stay.

21.  OPTION TO VACATE EARLY:  The Occupant must provide Whitestar Realty Trust at least 30 days written notice of the intended vacate date if it deviates from the dates in section 1.  Failure to do so will result in Occupant paying the full amount of the Contract Dates and/or Thirty Days for any additional stay past the Contract Date.

22.  SMOKING:  This is a non-smoking suite, Occupant will be responsible to replace any property damaged due to smoking at a replacement value.  A cleaning fee of $300.00 will be charged for any occupant who smokes in the suite.  Smoking is permitted outside of building only.  Occupant is responsible to properly dispose of smoking materials.
